G SESHADRI(SC FOR MPP ZPP) 2 The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring action of the respondents No. 1 to 4 more particularly the respondents No. 3 and 4 in trying to dispossess the petitioners from their respective house sites situated in Sy.No. 133 to an extent of three (3) cents each situated at Ganjihalli Village, Gonegandla Mandal, Kurnool District, at the instance of the 5th respondent as illegal, arbitrary, unjust, without any authoritiy and violative of Art. 14, 21 of the Constitution of India and consequently direct the respondents NO. 1 to 4 not to dispossess the petitioners from their respective house sites situated in Sy.No. 133 to an extent of three (3) cents each situated at Ganjihalli Village, Gonegandla Mandal, Kurnool District.” 2. Sri Md.Farooq, learned Assistant Government Pleader for Home would submit that Respondent No.5 obtained interim orders in W.P.No.23359 of 2017 dated 20.07.2017 and that a case in Crime No.120 of 2016 was registered against Petitioner No.3 and that Petitioners have produced fake pattas. Learned Assistant Government Pleader has placed the written instructions on record to that effect. For ready reference the same are extracted hereunder: “5. It is submitted that the respondent No. 5 approached this Hon'ble court vide WP.No.23359/2017 dated 20.07.2017 and obtained interim direction directing the Revenue and Panchayat officials not to interfere with Sy.No.133 which as per revenue record classified as Chowdamma Kunta. 6. It is submitted that all the contentions of the petitioner against the respondent No.3 are false and baseless. The petitioner No.1 to 3 created fake pattas and approached this Hon'ble Court with intention to encroach the Government land in Sy.No.133 of Ganjahalli Village, Gonegandla Mandal.” 3. None represented for the Petitioners. 3 4. In the light of the same, the Writ Petition is disposed of. However, the Respondents – Authorities are directed to proceed in accordance with law. There shall be no order as to costs.
