2. The petitioner is apprehending his arrest in connection with Jasidih PS Case No.274 of 2023, for offence registered under section 304(B)/34 of IPC, pending in court of learned Additional Chief Judicial Magistrate, Deoghar.

Learned counsel for petitioner submits that the petitioner happened to be husband of the deceased and initially the case was registered under section 304(B) of IPC and subsequently it has been converted under section 306 and 34 of the IPC. He also submits that the petitioner is not named in the FIR and in the post-mortem report, cause of death is found to be due to committing suicide and he further submits that the same has also come in the impugned order.
4. Learned State counsel opposes prayer and submits that petitioner is said to be husband of the deceased.

Considering that petitioner is not named in the FIR and initially the case was registered under section 304(B) of IPC and subsequently it has been converted under section 306 and 34 of the IPC on enquiry. It has also come in the impugned order of the learned Sessions Judge that doctor has opined the cause of death due to committing suicide, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Additional Chief Judicial Magistrate, Deoghar, in connection with Jasidih PS Case No.274 of 2023, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
