ORDER:
The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused Nos.2 to 4 on bail in Crime No.100 of 2025 of Salur Town Police Station, Parvathipuram Mandal, Manyam District, was registered against the Petitioners/Accused Nos.2 to 4 herein for the offences punishable under Section 20(b)(ii)(B), read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record, the allegation against the petitioners is that, they along with the other accused found in possession of 17.395 Kilograms of Ganja. It is alleged that the 1st petitioner/Accused No.2 was found in possession of 2.9 Kilograms of Ganja, the 2nd petitioner/Accused No.3 was found in possession of 5.6 Kilograms of Ganja and the 3rd petitioner/Accused No.4 was found in possession of 5.8 Kilograms of Ganja. The Petitioners/Accused Nos.2 to 4 was arrested on 02.08.2025 and they have been in judicial custody for the past 81 days. There were no criminal antecedents against the petitioners. So far, eight (08) witnesses were examined, material portion of the investigation in so far as the petitioners

concerned is completed. The petitioner/A-2 is a permanent resident of Tirruvur District, Tamil Nadu State. The petitioners/Accused Nos.3 and 4 are the permanent residents of Malkangiri District, Odisha State.
They have got fixed abode. The period for custodian interrogation is completed. 4. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioners/Accused Nos.2 to 4, this Court is inclined to enlarge the Petitioners/Accused Nos.2 to 4 on bail. 5. In the result, the Criminal Petition is allowed with the following stringent conditions: i. The Petitioners/Accused Nos.2 to 4 shall be enlarged on bail subject to they executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for the like sum each to the satisfaction of the learned Judicial First Class Magistrate, Salur, Vizianagaram District. ii. The Petitioners/Accused Nos.2 to 4 shall appear before the Station House Officer concerned, on every Saturday in between 10:00 am and 05:00 pm, till filing of the charge sheet. 4

iii. The Petitioners/Accused Nos.2 to 4 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. iv. The Petitioners/Accused Nos.2 to 4 shall not commit or indulge in commission of any offence in future. v. The Petitioners/Accused Nos.2 to 4 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer. vi. The Petitioners/Accused Nos.2 to 4 shall cooperate with the investigating officer in further investigation of the case and shall make themselves available for interrogation by the investigating officer as and when required. _________________________ DR.
