learned counsel appearing on behalf of the State.

Learned counsel appearing for the petitioners submits that the petitioner No.2 Subhash Yadav has been arrested, in view of that, he is not pressing anticipatory bail, so far as petitioner No.2 is concerned.
3. In view of that, anticipatory bail prayer of the Petitioner No.2 is hereby rejected as not pressed.
4. The petitioner No.1 Deepak Kumar is apprehending his arrest in connection with Sahibganj (M) P.S. Case No. 98/2024, registered under sections 191(2), 191(3), 190, 195(1), 115 (2), 117(2), 126(2), 127(2), 112(2), 121 (1), 186, 132, 221, 224, 351(2), 352 and 61(2) of BNS, 2023, pending in the Court of learned Additional Chief Judicial Magistrate, Sahibganj.

Learned counsel for the petitioners submits that earlier the petitioners have moved in A.B.A. No. 7951 of 2025 which was dismissed as withdrawn on 23.04.2025 and the present anticipatory bail application has been filed in view of the fact that two of the co-

accused persons have been granted anticipatory bail in A.B.A. No. 4415 of 2025 vide order dated 14.08.2025 and further three of co- accused persons whose A.B.A. No. 2475 of 2025 has also been dismissed as withdrawn, have already been granted anticipatory bail in A.B.A. No. 5292 of 2025. He then submits that one Pappu Yadav was assaulted by the police for that protest was being made and F.I.R. is against 70-80 unknown persons and 21 named accused persons. He further submits that there is general and omnibus allegation against all the accused persons including the petitioner. On these grounds, he submits that the petitioner No.1 Deepak Kumar may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations are there of entering into the scuffle with the police and earlier anticipatory bail of the petitioner has been dismissed as withdrawn.

In view of the above and considering that the petitioner has got no criminal antecedent as disclosed in para 14 of the petition and considering that by order dated 23.04.2025 the anticipatory bail of the petitioners has been dismissed as withdrawn and subsequent thereto by order dated 14.08.2025 two of the accused persons have been granted anticipatory bail in A.B.A. No. 4415 of 2025 and by
order dated 15.09.2025 the co-accused persons whose anticipatory bail application has also been dismissed, have been granted anticipatory bail in A.B.A. No. 5292 of 2025 and in view of that in changed circumstances, second anticipatory bail application can be

maintained and further there is general and omnibus allegation against all the accused persons including this petitioner No.1 and F.I.R. is against 70-80 unknown persons and 21 named accused persons, who were present at the spot.
8. In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner No.1. Accordingly, the above named, petitioner No.1 Deepak Kumar is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty-five thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Sahibganj, in connection with Sahibganj (M) P.S. Case No. 98/2024, subject to conditions as laid down under Section 482 (2) of B.N.S.S,
