Mrs. Mohona Das …for the appellant Mr. Sujit Sankar Koley …for the WBSEDCL 1. There is a delay of 152 days in filing the instant appeal. There is no application for condonation of delay despite a lapse of eight years in filing the instant appeal. 2. Accommodation was sought on an earlier date before a Co-ordinate Bench by counsel for the appellant to take steps on an earlier occasion dated 17th May, 2022. No steps appeared to have been taken. 3. Be that as it may the writ petition was filed by the widow of a deceased, claiming compensation from the WBSEDCL on account of the death of her husband after contacting the supplier lines of the licensee. 4. The application for compensation was considered by the WBSEDCL and rejected by an order dated 3rd June, 2015. The ground for rejection is that the writ petitioner’s husband was electrocuted 2 while trying to unauthorizedly hook on to the supply lines of the WBSEDCL to illegally draw the electricity. 5. In those circumstances, the impugned order passed by the Single Bench dated 12th January, 2017 even otherwise calls for no interference. 6. MAT 1158 of 2017 shall stand dismissed. 7. Interim order, if any, shall stand vacated. 8. There shall be no order as to costs. 9. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
