(ORAL) The present petition has been filed by the petitioner under Section 482 of BNSS, 2003 with a prayer for grant of anticipatory bail in case COMI- 35/2016 dated 11.03.2016 under Sections 420, 467, 468, 471 and 120-B of Indian Penal Code, 1860 registered at Police Station Sarhali, District Tarn Taran. The counsel for the petitioners submits that the petitioners are permanent residents of USA and earlier, they were declared proclaimed offenders but the said order was set aside by this Court vide order dated 04.02.2025 (Annexure P-5) subject to cost of Rs.15,000/-. The said cost has already been deposited by the petitioners and thereafter, the petitioners approached the Court of Learned Sessions Judge seeking grant of anticipatory bail but the said application was dismissed by the learned Sessions Judge, Tarn Taran. Mr. Ravi Mehra, Advocate accepts notice on behalf of the respondent/complainant and has filed his Power of Attorney in the Court today, which is taken on record. The counsel appearing on behalf of the respondent informed the Court that now, the matter has been compromised between the parties and the complainant is having no objection in case the petitioners are granted bail. In the light of the above, the present petition is hereby disposed of without expressing any opinion on the merits of the case and the petitioners are granted bail in criminal complaint titled as “Kewal Singh V/s Amrik Singh and others”, which is pending in the Court of Judicial Magistrate Ist Class, Tarn Taran, with direction to the petitioners to appear before the learned trial Court concerned within a period of next 20 days and on their doing so, the petitioners are to be released on regular bail by the Court concerned to its own satisfaction, subject to cost of Rs.5,000/- to be deposited by the petitioner with the District Legal Services Authority concerned.
