The petitioner has alleged violation of directions issued in para-6 of the order dated 31.10.2023 passed in Cr.M.P. No. 4087/2023 in Cr.M.P.(M) No. 1787/2023 whereby the respondent serving at the relevant time as Deputy Superintendent of Police, Nalagarh, Police District Baddi, District Solan, H.P. was directed “not to deal in any manner” with F.I.R. No.172 of 2023, dated 14.06.2023, under Sections 376, 506 and 34 of Indian Penal Code (IPC) as well as F.I.R. No. 194 of 2023, dated 13.07.2023, under Sections 387, 1 Whether reporters of the local papers may be allowed to see the judgment? yes 2 ( 2025:HHC:36235 ) 389, 416, 506 and 120-B of IPC, both registered at Police Station, Nalagarh, District Solan, H.P. 2. The respondent has filed comprehensive reply alongwith documents controverting the allegations levelled in the petition. 3. After arguing for sometime, learned counsel for the petitioner submitted that since the allegations levelled against the respondent would not stricto sensu constitute contempt of the order in question in view of well-settled legal position, the proceedings, therefore, be closed at this stage as petitioner intends to avail other appropriate remedy as may be available to him for the redressal of his grievance. 4. In view of above submissions and taking note of stand of respondent in his reply and the legal position, present proceedings are closed. Notice issued to the respondent is discharged. Needless to clarify that it shall be open for the petitioner to avail appropriate remedy as may be available to him for the redressal of his grievances in accordance with law.
