This petition has been filed seeking direction to issue a suitable order or direction commanding the Court to direct the Court of Judicial Magistrate, Hathras to consider and decide the Complaint No. 239 of 2024 (Sonpal Singh Vs. Saurabh) under Section 138 of the Negotiable Instruments Act, 1881, Police Station-Hathras Junction, District-Hathras in accordance with law within a period of time specified by this Hon'ble Court. It is submitted by learned counsel for the petitioner that Section 143(3) of Negotiable Instrument Act clearly provides expeditious disposal of cases filed under Section 138 of the N.I. Act. Considering the aforesaid facts and circumstances of the case and without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court concerned to decide the aforesaid case in accordance with the provisions of Section 143(3) of N.I. Act, as expeditiously as possible, after giving opportunity of hearing to both the parties, without granting any unnecessary or long adjournments to either of the parties, from the date of production of a certified copy of this order, if there is no other legal impediment.
