For the State : Mr. Tarun Kumar, APP ----- 02/02.05.2025: This is an application filed by the petitioner praying for grant of anticipatory bail in terms of sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023, as the petitioner has been allegedly implicated in connection with Jharia PS case no. 162 of 2023 registered for the offences punishable under sections 306, 406 and 420 of the Indian Penal Code, pending in the court of learned Additional Chief judicial Magistrate, Dhanbad. 2. Heard the learned counsel for the petitioner, learned counsel appearing on behalf of the State. 3. The learned APP opposes the prayer for anticipatory bail of the petitioner. 4. The instant case arises out of CP Case No. 7909 of 2023 which was converted into FIR u/s 156 (3) of the Cr.P.C. 5. As per FIR, the petitioner has taken Rs. Total 17 lakhs and jewellery from the brother and sister of the informant and when they demanded the same, she refused to return the cash and jewellery and then sister of the informant committed suicide for which UD case no. 21 of 2020 was instituted. 6. From the materials on record, I find that death has occurred on 3.9.2020 for which UD case no. 21 of 2020 was already registered. The instant complaint making the aforesaid allegation was filed on 19.5.2023. 7. Considering the huge delay in lodging the complaint, I am inclined to release the petitioner on anticipatory bail. Accordingly, the petitioner, above named, is directed to surrender before the court below within four weeks from today and in the event of his surrender/arrest the learned court below is directed to enlarge him on bail on furnishing bail bond of Rs. 10,000/- (rupees ten 2025:JHHC:13254 thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief judicial Magistrate, Dhanbad, in connection with Jharia PS case no. 162 of 2023, subject to the condition that one of the bailers should be close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/ her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the learned trial court indicating his /her share in the property.
