On prayer of the petitioner, liberty is granted to implead the Additional District Magistrate (P & RD), Hooghly as respondent no.9 in the writ petition. The cause title of the writ petition be amended accordingly. Since the State is represented, service of notice upon the added respondent is dispensed with. Report submitted by the State is taken on record. The petitioner has been nominated as the leader of opposition in Hooghly Zilla Parishad by the concerned political dispensation and such nomination was communicated to the Additional District Magistrate, Hooghly by a letter issued on 14th August, 2024. The petitioner complains that despite such communication, he has not been recognized as the leader of opposition in the concerned Zilla Parishad. 2 It appears from the report submitted by the State that though the President of the concerned political dispensation submitted a communication on 14th August, 2024 regarding proposal of opposition leader of Hooghly Zilla Parishad, the minutes of the meeting in favour of the petitioner as per Section 213A of the West Bengal Panchayat Act, 1973 have not been submitted. The petitioner seeks liberty to submit such minutes before the Additional District Magistrate (P & RD), Hooghly. Such liberty is granted. Upon receipt of the same, the Additional District Magistrate (P & RD), Hooghly shall consider the same in terms of the Act of 1973. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
