The Court made the following ORAL ORDER:
Heard Sri G. Itihaas, Ld. Counsel appearing on behalf of Sri Mr. Rajesh Matcha, Ld. Counsel for the Writ Petitioner and Sri Arjun Chowdary, Ld. Asst. Government Pleader.
2. Learned Asst. Government Pleader has submitted the Written Instructions dated: Nil furnished by the Tahsildar, Kotauratla Mandal, Anakapalli Mandal. Copy of it is supplied to the Ld. Counsel for the Writ Petitioner and the same is taken on record.
3. The Written Instructions would indicate that the Writ Petitioner was not present at the survey. But two persons on his behalf were present during the survey when the marking of the boundaries was done and that the two persons who had attended the survey on behalf of the Writ Petitioner have agreed to the survey done. It is also stated in the Written Instructions that the Writ Petitioner has encroached the agricultural land of the Complainant herein. Despite the time having been granted to the Writ Petitioner to implead Sri Gudivada Appala Naidu, who is the Complainant, the Writ Petitioner has not taken any steps to do the needful. In this view of the matter, non-joinder of necessary parties is fatal to the case.
4. Accordingly, this Writ Petition is dismissed for non-joinder of necessary parties despite granting time. No order as to costs.
5. Interlocutory Applications, if any, stand closed in terms of this order.
