04/16.10.2025 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending her arrest in connection with Argora P.S. Case No.175/2025, registered for the offence under Sections 376/506 of the IPC, Section 6 of POCSO Act and Section 79 of Juvenile Justice Act, pending in the Court of the learned A.J.C.IV cum Special Judge, POCSO, Ranchi.

Learned counsel appearing for the petitioner submits that so far as the allegation with regard to POCSO Act is concerned, that is against one Santosh Lakra. He further submits that so far as the said Santosh Lakra is concerned, he has filed another anticipatory bail application in which case diary has been called and interim protection has been granted in his favour. He then submits that so far as the present petitioner is concerned, she is a lady and there is no allegation against her under the POCSO Act. He next submits that only allegation is there against the petitioner that she used to take household work from the victim.

Learned counsel appearing for the State opposed the prayer and submits that the petitioner is the wife of Santosh Lakra against whom there is allegation under the POCSO Act.

Considering that only allegation is there against the petitioner that she used to take household work from the victim and prima facie case under the POCSO Act is not made out against the petitoner and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of her arrest or surrender, she will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.J.C. IV cum Special Judge, POCSO, Ranchi in connection with Argora P.S. Case No.175/2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
