SUTHAR Date : 25/07/2025 ORAL ORDER By way of present petition under Article 226 of the Constitution of India read with Section 528 of the BNSS, the petitioners have prayed to issue the writ of mandamus or any other appropriate writ in nature of mandamus against the respondent No.2 and direct the respondent No.2 to act upon the written complaint dated 13.05.2024 of the petitioner and register the FIR against the accused and others to investigate and inquire properly and thoroughly in the complaints filed by the petitioners. Perusing the grievance it appears that the petitioner has approached the respondent Authority – Police Inspector, Talod Police Station on 13.05.2025 which is produced at Annexure-A to the petition. Pursuant to the order dated 17.01.2025 passed by the coordinate Bench in Special Criminal Application No.631/2025, the respondent authority has considered the representation / complaint of the present petitioner and communicated the same to the petitioner vide communication R/SCR.A/6926/2025 ORDER DATED: 25/07/2025 dated 07.02.2025, which is produced at Annexure-D to the petition wherein it is clearly stated that the representation / complaint of the petitioner fails considering the civil dispute. It is needless to say that if the petitioner is having any dissatisfaction or grievance with the said communication at Annexure-D, the petitioner shall have liberty to file appropriate proceeding before appropriate forum rather than approaching this Court by way of second round of litigation on the same cause, no case is made out to issue any direction. With aforesaid direction, present petition is disposed of. It is made clear that the Court has not examined the merits of the case. (HASMUKH D. SUTHAR, J.)
