[2025:RJ-JP:31875] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Application No. 692/2024 In S.B. Criminal Miscellaneous Petition No. 4217/2024 Rahul Srivastava Son of Shri Virendra Srivastava, Resident of 1863, Dampier Nagar, Mathura, Uttar Pradesh. ----Petitioner Versus 1. State of Rajasthan, Through P.P. 2. Stuti Johari Wife of Rahul Srivastava, Daughter of Shri Gopal Krishna Johari, Resident of E-1-601, Mahalaxmipu- ram, Baran Road, Kota. ----Respondents For Petitioner(s) : Mr. Satish Chandra Pachori For Respondent(s) : Mr. Vivek Choudhary, PP HON'BLE MR. JUSTICE SUDESH BANSAL Order 14/08/2025 1. This misc. application has been filed by the petitioner seeking to restore the S.B. Criminal Misc. Petition No. 4217/2024, which was dismissed due to non-compliance of the peremptory order dated 05.09.2024. 2. It appears that in the S.B. Criminal Misc. Petition No. 4217/2024, petitioner raised a grievance that he sought to change his Advocate to contest the criminal trial for offences under Sections 498A and 406 IPC, yet trial Court vide impugned order dated 07.05.2024 did not allow the petitioner to engage new counsel and issued arrest warrant against the petitioner vide order dated 22.05.2024. 3. Undisputedly, thereafter petitioner has appeared before the trial Court and has been released on bail vide order dated [2025:RJ-JP:31875] (2 of 2) [CRLMA-692/2024] 10.06.2024. It is also admitted that petitioner has been allowed to engage new counsel and presently, he is being represented through counsel of his choice in criminal trial. 4. In that view of the matter, no purpose would be served to restore the S.B. Criminal Misc. Petition No. 4217/2024 for hearing on merits, since the grievance of petitioner stands resolved. 5. Counsel for petitioner too does not dispute such proposition. 6. Accordingly, the application for restoration stands disposed of. (SUDESH BANSAL),J NITIN /38
