NC: 2025:KHC:10333 CRL.P No. 13118 of 2024
PENDING BEFORE THE II ADDL.DISTRICT AND SESSIONS BENGALURU RURAL BENGALURU SEC.498A, 494, 420 OF IPC AND SEC.3(1)(r)(s) OF SC/ST (POA) ACT.
THIS PETITION, COMING ON FOR ORDERS, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR JUSTICE HEMANT CHANDANGOUDAR
ORAL ORDER
1. The petitioner/accused, who has been charge- sheeted for offences punishable under Sections 498A, 494, and 420 of the IPC, along with Section 3(1)(r)(s) of the SC/ST (Prevention of Atrocities) Act, has approached this Court seeking relief.
2. The prosecution alleges that the petitioner/accused, being the husband of the de facto complainant, subjected her to both mental and physical cruelty and also abused her with caste-based derogatory remarks. It is further alleged that the petitioner/accused contracted a second marriage during the subsistence of his marriage with the de facto complainant.
3. Both parties are present before this Court and have filed a joint memo seeking the compounding of the offences, stating that they have amicably resolved their dispute. As per the terms of the settlement, the de facto complainant has agreed to withdraw all allegations and has no objection to quashing the impugned proceedings.

NC: 2025:KHC:10333 CRL.P No. 13118 of 2024
4. The joint memo, along with the affidavit, is placed on record.
5. Although the alleged offences are cognizable and non-compoundable, given that the parties have amicably settled the matter, subjecting the petitioner/accused to a trial would serve no meaningful purpose, as the probability of conviction is remote and bleak in light of the settlement. Under such circumstances, the continuation of criminal proceedings would amount to an abuse of the process of law.
ORDER i. Accordingly, petition is allowed. The impugned proceedings in Spl.C.No.383/2024 on the file of II Addl. District and Sessions, Bengaluru Rural, Bengaluru is hereby quashed.
