In the instant petition filed under Article 226 of the Constitution of India, the short grievance projected by the petitioner is that he, the petitioner, although, came to be engaged as Computer Operator on temporary basis, w.e.f., 15.01.2016 by the respondents initially against the payment of monthly remuneration of Rs. 8,000/- and subsequently enhanced to Rs. 12,000/-, the respondents did not release the same, w.e.f., 15.06.2017 upto December, 2021, and that, he, the petitioner also came to be illegally disengaged in terms of order dated 31.12.2021, which order is impugned in the petition. 2. Upon coming of the matter for consideration today, the counsel for the petitioner would contend that the respondents in the objections filed to the petition have admitted the liability of payment of the unpaid remuneration to the petitioner to the tune of Rs. 6,36,000/- and in this connection a communication stands addressed by the Deputy Commissioner, Udhampur to the Divisional Sr.No. 111 2 WP(C) No. 1384/2022 Commissioner, Jammu for obtaining concurrence from the Finance Department and consequential payment thereof to the petitioner. 3. Learned counsel for the petitioner would, thus, seek disposal of the writ petition, at this stage, notwithstanding the challenge to the disengagement order dated 31.12.2021, with a direction to the respondents to pay the unpaid remuneration to the petitioner without any further delay. 4. On the contrary, counsel for the respondents admits of the submissions of the counsel for the petitioner qua the proposed payment of the unpaid honorarium to the petitioner. The counsel for the respondents also agrees to the disposal of the petition as proposed by the counsel for the petitioner. 5. Having regard to the aforesaid respective submissions of the appearing counsel for the parties, the instant petition is disposed of at this stage with their consent, requiring the respondents to ensure the payment of the unpaid honorarium to the petitioner for the period in question, without any further delay, preferably within a period of six weeks from the date of passing of this order.
