Heard Sri Sumit Daga, learned counsel for the petitioner and Sri H.R.Pandey, learned counsel for the respondents. The possession of the demised premises has already stood transferred to the landlord respondent. According to learned counsel for the respondent nothing survives in the matter, however, Sri Daga submits that damages that have been directed to be paid are too high, however, his client is ready to pay Rs. two lakhs in lumpsum but court may consider payment in two equal installments. Learned counsel for the does not have objection in the vent petitioner pays Rs. two lacs towards damages of the premises in question. In view of above, this petition stands disposed of with direction to the petitioner to give undertaking within two weeks from today or in any circumstances latest by 1st March, 2025 that he would be depositing Rs. 2 lacs in two equal installments, first installment shall be deposited before executing court one on or before 1st March, 2025 and remaining amount of Rs. on lac to be deposited on or before 14th August, 2025. Thus, the judgment and decree passed by trial judge stands modified accordingly as far as damages are concerned and in the event petitioner fails to deposit first installment of Rs. one lac within two weeks and / or latest by 1st March, 2025, the entire amount shall be recoverable as arrears of land revenue. With these observations and direction, this petition stands disposed of.
