For the respondents: Mr. Virender Kanwar, Advocate. Jyotsna Rewal Dua , J Notice. Mr. Virender Kanwar, learned counsel, appears and waives service of notice on behalf of respondents. 2. This writ petition has been filed for the grant of following substantive reliefs:-
“i) That a writ in the nature of mandamus may kindly be issued and Office Order dated 12.04.2013, may kindly be modified to the extent that the petitioner is re-appointed on regular basis and respondent corporation may kindly be further directed to release consequential service benefits in favour of petitioner in the interest of justice. ii) That a writ in the nature of mandamus may kindly be issued directing respondent corporation to consider the case of petitioner for pension in view of law settled by this Hon’ble Court in number of cases, in the interest of justice. iii) That in alternate, a writ in the nature of mandamus may kindly be issued directing respondent corporation to consider 1 Whether reporters of the local papers may be allowed to see the judgment? yes
2 the case of petitioner for pension by counting his contract service period, in the interest of justice.”

Learned counsel for the petitioner submits that she is under instructions not to press relief No.(i) which prayer even otherwise cannot be entertained at this stage in view of unexplained delay, laches and acquiescence. Learned counsel, however, submits that petitioner is entitled for grant of pension in case the respondents consider the contractual service rendered by the petitioner w.e.f. 12.04.2013 followed by his regularization on 21.07.2017. The petitioner superannuated on 31.03.2025 after putting in four years and three months of service on contract basis and seven years, eight months and twenty days on regular basis.
For counting the contractual service towards grant of pension, reliance has been placed upon Ravinder Singh Rana versus State of H.P.2 Learned counsel submitted that petitioner would be satisfied in case he is permitted to make a representation to the respondents for considering the contractual service rendered by him followed by regularization for grant of pension in light of above decision with direction to respondent/Competent Authority to consider his case, in accordance with law, within time bound schedule. Learned counsel for the respondents has no objection to this prayer. 4. In view of above, the writ petition is disposed of by permitting the petitioner to make a fresh representation to the 2CWP No.9184/2023, decided on 18.12.2025. 3 respondents/competent authority, within a period of two weeks from today for the redressal of his grievances, who shall in turn, consider and decide the same, in accordance with law, keeping in view Ravinder Singh Rana2 within a further period of six weeks. The order so passed be also communicated to the petitioner. Pending miscellaneous application(s), if any, shall also stand disposed of. Jyotsna Rewal Dua Judge 30th December, 2025(yogesh)
