3 10^ RRR,J W.P.No.l2078of2016 The Court made the following order: The petitioner herein claims ownership over Ac.0.05 cents of land in Sy.No.91 of Avilala Village, which is said to have been acquired under a registered deed of sale, dated 02.01.1989. The petitioner contends that this land was taken over by the Government, for the purpose of laying a road, with the assurance of allotment of alternative land in Sy.No.18 of Avilala Village. However, such land could not be allotted to the petitioner and the other affected persons as the said land was Tank Poramboke land which could not be allotted to anybody. 2. Thereafter, no further action was taken for allotment of the alternative land. Aggrieved by the said inaction, the petitioner has approached this Court, by way of W.P.No.27164 of 2010, seeking allotment of alternative land. This Court, by an order, dated 24.11.2011, disposed of the Writ Petition, with a direction to respondents 2 & 3 therein, to consider the claim of the petitioner and to take a decision within three months. It may also be recorded that the Revenue Authorities had specifically contended that they had not utilized any land of the petitioner for the formation of the road.
Thereupon, the petitioner is said to have filed a list, which is said to be issued by the Mandal Revenue Officer, Tirupati Rural Mandal, giving the list of the details of alternative land to the land losers, who lost their land in the formation of the road and the petitioner was shown at

A perusal of the record would show that there is no document produced by the petitioner to demonstrate that she had been given an assurance by the Authorities for allotment of alternative land.
However, the fact remains that the petitioner has produced a statement, said to have been recorded by the Tahsildar of Tirupati Rural Mandal on 19.10.2013, wherein, she had given her consent for allotment of alternative land in Sy.No.528 to an extent of Ac.4.75 cents of land in Peruru Village. This document has not been denied by either of the respondents in their counter affidavit. In the absence of
