The Writ Petition is filed questioning the action of the respondents in withholding the amounts even after completion of works and finalization of the bills payable to the petitioner in respect of the works executed by him under the Programme “Gadapa Gadapaku Mana Prabhutvam” i.e. (i) Providing C.C Road from Adarshnagar Sub-Jail Drain Culvert E.P.No.11/159 to Transformer in Division No.11 of Machilipatnam Municipal Corporation for an amount of Rs.11,45,000/- vide Work ID:MAUD-1070-29136, (ii) Providing C.C. Drain in Anjaneya Swamy Temple Road from E.P.No.11/123 to E.P.No.11/224 in Division No.11 in Machilipatnam Municipal Corporation for an amount of Rs.1,78,000/- vide Work ID:MAUD- 1070-29141, totaling to an amount of Rs.13,23,000/-, as illegal and arbitrary. 2. Heard Sri Akula Vamsi Krishna, learned counsel for the Petitioner and Sri A.S.C. Bose, learned Standing Counsel for the Respondent-Corporation. 3. At the time of hearing, the learned Standing Counsel for the Respondent-Corporation passed on written instructions received by him, signed by the Commissioner, Machilipatnam Municipal Corporation, wherein it is revealed that the writ petitioner had completed the works executed by him, but due to technical error occurred in CFMS portal, the bills could not be paid to him and the same has to be rectified and whenever the amounts released under GGMP Funds, the amounts due to the writ petitioner will be paid. 3 4. 3 4. In view of the aforesaid submissions and also considering the fact that there is no dispute with regard to the execution of works and the amounts due to the writ petitioner, this Court is inclined to dispose of the Writ Petition, with the consent of both sides and by placing the written instructions on record, with the following direction: (i) The Respondent authorities are directed to pay the amounts due to the writ petitioner within a period of four (04) months from the date of receipt of the copy of this order.
