It is not disputed that fresh demand notice dated 15.05.2025 under Section 13 read with Rule 3 of the Security Interest (Enforcement) Rules, 2002 (for short ‘the Rules’) has been issued, in pursuance to which a subsequent order has been passed on 01.10.2025 under Rule 8(1) of the Rules, whereby possession notice has been issued. The same is subsequent to the order passed by the learned Single Judge. 3. In such circumstances, the learned Counsel for the appellant is permitted to withdraw the present appeal with liberty to press for his remedy, in accordance with law. 4.
