ORDER:
The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Sole Accused on bail in Crime No.142 of 2025 of III Town Police Station, Visakhapatnam District, was registered against the Petitioner/sole Accused herein for the offences punishable under Sections 69,

318(4), 308(5), 127(3), 131, 351(2) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’). 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. The petitioner/sole accused is a married man aged about 37 years and is employed as a driver in a travel company. The respondent No.2/victim/defacto complainant is a married woman aged about 34 years. As seen from the complaint lodged by respondent No.2, it appears that the petitioner and respondent No.2 were in a live-in relationship for quite some time. Subsequently, certain misunderstandings arose between them. Respondent No.2 has alleged that the petitioner induced her to marry him and started living with her. He is further alleged to have induced her to avail a car loan of Rs.13 lakhs, and the vehicle was registered in the name of the petitioner’s wife. Later, the EMIs were not paid. Respondent No.2 also alleged that the petitioner and his wife harassed her and threatened to kill her. The defacto complainant further alleged that she was wrongfully confined for three days, assaulted, and intimidated. Based on the complaint lodged by respondent No.2, the police registered a case in Crime No.142 of 2025. The petitioner surrendered on 29.07.2025 before the police and was subsequently remanded to judicial custody by the learned Judicial Magistrate. He has been in judicial custody for the past 84 days. The period for custodial interrogation is also completed. So far, nine (9) witnesses have been examined.
Except for the receipt of the RFSL report,

the material part of the investigation has been completed. The petitioner is a permanent resident of Visakhapatnam. He has got fixed abode. 4. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioner/sole Accused, this Court is inclined to enlarge the Petitioner/sole Accused. 5. In the result, the Criminal Petition is allowed with the following stringent conditions: i. The petitioner/sole Accused shall be enlarged on bail subject to he executing a bond for a sum of Rs.25,000/- (Rupees twenty five thousand only), with two sureties each for the like sum each to the satisfaction of the learned IV Additional Chief Metropolitan Magistrate, Visakhapatnam. ii. The petitioner/sole Accused shall appear before the Station House Officer concerned, on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court. iii. The petitioner/ sole Accused shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. iv. The petitioner/sole Accused shall not commit or indulge in commission of any offence in future. v. The petitioner/sole Accused shall cooperate with the investigating officer in further investigation of the case and shall make himself available for interrogation by the investigating officer as and when required. 4
vi. The petitioner/sole Accused shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer. vii. The petitioner/sole Accused shall surrender his passport, if any, to the investigating officer.
