1. In the instant contempt petition, the petitioners have alleged non- compliance of order dated 21.08.2017 in terms whereof while disposing of the writ petition of the petitioners being SWP No. 2045/2017, the respondents came to be directed to consider the case of the petitioner for appointment under the Prime Ministers Special Package for Return And Rehabilitation Scheme in terms of Advertisement Notice no. 01 of 2012 dated 09.07.2015 while having regard to the averments of the writ petition as also the judgment mentioned thereunder.
2. Statement of facts has not been filed by the respondents. However, status report has been filed by respondent No. 1.
3. Learned counsel for respondent Nos. 2 has produced the copy of the statement of facts in the open Court which is taken on record.
4. As per the statement of facts filed by respondent No. 1, in tune with order passed by this Court, the case of the petitioners stands considered and
consideration order dated 26.09.2017 stands passed keeping in view the overall vacancy position, all the posts i.e. 3000 Supernumerary posts created under the Prime Ministers Special Package for Return and Rehabilitation Scheme of the migrants stands filled up on the recommendations of recruitment agencies and the posts which remains unfilled due to non-availability of suitable candidates

stands also filled up vide order dated 08.08.2017 passed in various writ petitions/ LPAs, thus, rendering the claim of the petitioners devoid of any merit.
5. In the statement of facts filed by respondent no. 2, it is stated that the case of the petitioners’ stands considered and a consideration order dated 26.09.2017 stands passed.
6. Having regard to the aforesaid stand taken by the respondents/ contemnors, the judgment and order has been implemented by the respondents/ contemnors.
7. However, since none has appeared for the petitioners on the last three consecutive dates of hearings, the contempt notice issued is recalled and the contempt proceedings are closed with a liberty to the petitioners to seek revival of the contempt petition within four weeks from today in case the cause survives.
