JUSTICE ARINDAM LODH Order 09/01/2025 Heard Mr. BN Majumder, learned senior counsel assisted by Mr. DJ Saha, learned counsel appearing for the applicant. Also heard Mr. Raju Datta, learned PP appearing for the respondent-State. In pursuant to the Order dated 07.01.2025, learned PP has produced the case diary relating to the instant case. Mr. Majumder, learned senior counsel appearing for the applicant has submitted that the applicant is innocent. He has also submitted that all the accused persons involved in this case have already been enlarged on bail and thus, he has prayed for bail of the applicant. Mr. Datta, learned PP has raised objection to the bail prayer. I have perused the case diary and also gone through the medical report of the victims. From the medical report it is revealed that the injuries suffered by the victims are simple in nature. Moreover, other accused persons involved in this case have already been enlarged on bail. This court vide order dated 07.01.2025 enlarged the present applicant on interim bail till today. There is also no adverse report from the Investigating Officer. In view of the above, I am inclined to grant anticipatory bail to the present applicant. Accordingly, in the event of arrest, the applicant, namely, Sri Priyotosh Choudhury, may be released on bail on executing a bond of Rs. 25,000/- with one surety of the like amount to the satisfaction of the arresting authority. With the aforesaid order, the instant bail application stands allowed and thus disposed of. Return back the case diary.
