2. Petitioners have been made accused in connection with Jamua P.S. Case No. 107 of 2025 for the offences registered under sections 115(2), 118(1), 109, 117(4), 3(5) and 103 of the Bharatiya Nyaya Sanhita, 2023, pending in the court of Ms. Sushila Hansda, learned Judicial Magistrate, 1st Class, Giridih.
3. Petitioners and co-accused persons are alleged to have assaulted the son of the Informant namely Noor Muhammad, due to which, he succumbed to his injuries.
4. It was submitted that there is general and omnibus allegation against seven accused persons of having assaulted the deceased.
5.
Learned counsel for the Informant has vehemently opposed the prayer for bail and submitted that the bail application of one of the co-accused Babulal Yadav has been rejected by a Coordinate Bench of this Court.
6. From perusal of the order of rejection of the co-accused Babulal Yadav, it appears that the Coordinate Bench has rejected his bail application on the ground that there was specific allegation of assault against him.
7. Considering the fact that there is general and omnibus allegation of assault against the petitioners, I am inclined to enlarge the petitioners on bail. Accordingly, petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) each, with two sureties of the like amount each, to the satisfaction of Ms. Sushila Hansda, learned Judicial Magistrate, 1st Class, Giridih in connection with Jamua P.S.
