[2025:RJ-JP:1323] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 15774/2024 Khemraj S/o Shrikishan, Aged About 33 Years, R/o Dera Road Saloli, Police Station Raini, District Alwar (Rajasthan) (At Present In Sub Jail Rajagarh, District Alwar). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Surendra Singh Sunda, Adv. For Respondent(s) : Mr. Shri Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 09/01/2025 1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.155/2024, registered at Police Station Raini, District Alwar, for the offence(s) under Sections 302, 143, 323 and 341 of IPC. 2. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is argued that in the ‘Parcha Bayan’, injured Kishan Lal has specifically stated that the other co-accused Shree Kishan caused injuries to him and to the other deceased Dharmendra. Similarly, other eye-witness Kamlesh w/o Kishanlal and Komal w/o Dharmendra have also stated in their statements that the injuries caused to Dharmendra at his head was caused by Shree Kishan. It is also contended that deceased Dharmendra received one injury at his head, which is attributed to the other co-accused. It is argued that initially in the FIR names of Gita Devi and Pappi Devi have also been mentioned [2025:RJ-JP:1323] (2 of 2) [CRLMB-15774/2024] in assaulting the injured Kishan Lal and deceased Dharmendra, but the Police did not find their involvement. The accused- petitioner is in custody since 03.06.2024 and trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail application. 4. Heard and perused the material available on the record. 5. Considering the fact that the injuries caused to the deceased Dharmendra are attributed to the other co-accused Shree Kishan. Deceased Dharmendra has received one injury which is attributed to the other co-accused Shree Kishan, it is not desirable to express anything on the merits of the case, the accused-petitioner is in custody since long and the trial of the case may take considerable time, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioner- Khemraj S/o Shrikishan, in connection with FIR No.155/2024, registered at Police Station Raini, District Alwar, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
