JUSTICE PRAVEER BHATNAGAR [2025:RJ-JP:1351] (2 of 3) [CRLMB-15781/2024] Order 09/01/2025 These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No. 442/2024 registered at Police Station Sikri, District Deeg for the offence under Sections 319(2), 318(4), 338, 336(3), 340(2), 317(2), 317(4), 317(5), 303(2), 313 and 61 (2) (a) of BNS and Section 66-D of IT Act. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. Offences alleged to have been committed by the petitioners are triable by Magistrate. The accused-petitioners are in custody since 24.11.2024 and the trial of the case may take considerable time, therefore, the petitioners may be enlarged on bail. Per contra, learned Public Prosecutor opposes the grant of bail applications. Considering the arguments advanced by the counsel for the parties and looking to the fact that the case of the petitioners is triable by Magistrate, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused- petitioners on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioners 1. Sahukar S/o Akbar, 2. Sahil @ Sohil S/o Rajak, 3. Rafeek S/o Kursheed, 4. Kaif S/o Parmeen, 5. Shokeen S/o Sahab Kha, 6. Baneen @ Banee S/o Nabbu,in connection with FIR No. 442/2024 registered at Police Station Sikri, District Deeg shall be enlarged on bail provided each of them furnish a personal bond in the sum of [2025:RJ-JP:1351] (3 of 3) [CRLMB-15781/2024] Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
