Order
[2025:RJ-JP:19674] (2 of 4) [CW-618/2025] 09/05/2025
1. Since common question of law and facts are involved in both these writ petitions, hence with the consent of counsel for the parties, arguments have been heard together and both these writ petitions are being decided by this common order.
2. For convenience, the prayer mentioned in SB Civil Writ Petition No.618/2025 has been taken into consideration:
“It is therefore, most humbly prayer that this Hon’ble Court may graciously be pleased accept and allow this writ petition; and further be pleased to direct the respondent No.2 the Registrar, Education Departmental Examinations, Bikaner to carry out the correction in the II year marks-sheet of the petitioner of Diploma in Elementary Education (D.L.Ed.) Examination-2021, thereby showing the certificate of Scouts and Guide Training in the marks sheet. Any other order/ direction / relief which this Hon’ble Court deems proper in the facts and circumstances of the case may also be passed in favor of the petitioner along with cost.”
3. By way of filing this writ petition, a direction has been sought against the respondents to carry out the correction in the second year mark-sheets/certificate of Diploma in Elementary Education (D.El.Ed.) Examination showing therein that the petitioner has completed his certification in Scouts and Guide training.
4.
Learned counsel for the petitioner submits that completion of the course of Scouts and Guide is not in the syllabus prescribed for the examination of D.El.Ed. Counsel submits that the petitioner has passed the aforesaid course after appearing in the D.El.Ed.
[2025:RJ-JP:19674] (3 of 4) [CW-618/2025] examination. Learned counsel submits that for no reason, the respondents are not endorsing this fact in the mark-sheets/certificate of the petitioner in view of the fact that the petitioner has not passed the aforesaid course of Scouts and Guide in stipulated time. Learned counsel submits that in absence of such endorsement in his mark-sheets/certificate of D.El.Ed., he is facing great difficulty in getting the employment, so appropriate directions be issued to the respondents for doing the needful as sought for in the writ petition.
5. Per contra, learned counsel for the respondent-State opposes the arguments raised by learned counsel for the petitioner and submits that as per the guidelines framed by the respondents, each student is required to participate in seven days Scouts and Guide Camp and their result would not be declared, in case, they fail to attend the aforesaid camp. Learned counsel submits that though the petitioner has attended the camp but the same has been done after appearing in the final year examination, so under these circumstances, this fact has not been endorsed in her mark- sheets/certificate, therefore, interference of this Court is not warranted.
6. Heard and considered the submissions made at Bar and perused the material available on the record.
7. Perusal of the record indicates that the petitioner has completed her certification by attending the scout and guide camp after passing of examination and declaration of her result. Completing the aforesaid course or attending the aforesaid camp is not a requisite condition in the syllabus of D.El.Ed., as once the petitioner has already completed the certification for scout and
[2025:RJ-JP:19674] (4 of 4) [CW-618/2025] guide course after declaration of her result, the respondents are supposed to endorse the aforesaid fact in her mark-sheets/certificates.
8. Therefore, this Court finds no substance in the arguments advanced by learned counsel for the respondents, as the guidelines issued by the respondents are not in conformity with the syllabus prescribed by the authority.
9. In view of above, both these writ petitions stand allowed. The
respondents
are
directed
to
issue

10. Needless to observe that the order passed by this Court would be complied by the respondents within a period of four weeks from the date of receipt of certified copy of this order.
11. A general mandamus is issued to the respondent-State to incorporate/endorse this fact in the mark-sheets/certificate of each and every student, who have completed the certification of the aforesaid course of Scouts and Guide after passing the examination of D.El.Ed.
12. Stay applications as well as all applications (pending, if any) stand disposed of.
