The petitioner is alleging that the private respondents have put up a construction by encroaching upon the land belonging to the Public Works Department (P.W.D); thereby, has caused obstruction in the ingress and egress to his house; he is praying removal of the said structure. A report was called for from the Block Land & Land Reforms Officer, Kulpi, South 24 Parganas, the respondent no. 5 herein; such report was filed, wherefrom it appears that both the petitioner and the private respondents have encroached upon the P.W.D land. The representation of the petitioner dated November 02, 2021, praying removal of the said alleged encroachment, is pending consideration before different authorities including the Executive Engineer, Public Works Department (Road), Diamond Harbour, District: 24 Parganas (South), the respondent no. 3 herein. The said representation forms part of the writ petition being Annexure ‘P-4”. The respondent no. 3 is directed to consider and dispose of the said representation in accordance with law after giving the petitioner and all concerned an opportunity of hearing, as expeditiously as possible, preferably within a period of six weeks from the date of communication of this order.
