1. By way of the present petition, the petitioner has prayed for the following reliefs:- 10.1 That, this Hon’ble Court may kindly be pleased to issue a writ/order/direction, directing to the respondents to pay the compensation to the petitioners forthwith for their land which has been acquired for construction of road in accordance with the compensation granted by the learned tribunal in earlier order dated 09.04.2018(P/1). 10.2 That if the Hon’ble Court may deem fit and proper may kindly be pleased to call for the entire records pertaining to petitioner’s matter. 10.3 That, this Hon’ble Court may kindly be pleased to grant any other relief(s), which is deemed fit and proper in the aforesaid facts and circumstances of the case. 2. The brief facts of the case are that the lands of the Petitioners bearing Khasra No.191/1, area 0.03 acres; 177, 0.13 acres; 177/3, 0.11 acres; 177/12, 0.09 acres and Khasra No.196/2, 0.08 acres were acquired for construction of Sarhar-Kumhari Kala Road though the compensation was granted to the petitioners but feeling aggrieved with the quantum of compensation, the Petitioner No.1 filed a case under Section 51 of the Land Acquisition Act, in which the award was passed and the compensation was granted to the petitioners.
Since some other part of the land of the petitioners were affected on
3 / 3 account of construction of the aforesaid Road, therefore, in the year 2019 a supplementary land acquisition proceeding was initiated, however, despite completion of the aforesaid supplementary land acquisition till date no compensation has been granted to the petitioners and the petitioners have made a representation on 11/03/2025 but till date nothing has been done. 3. At this juncture, learned counsel for the petitioners would submit that he would confine his prayer for seeking a direction towards the respondent authorities to decide the pending representation of the petitioner. 4. Learned State counsel submits that she has no objection in deciding the representation of the petitioners. 5. I have heard learned counsel for the parties and perused the documents with utmost circumspection. 6. Considering the limited prayer made by learned counsel for the petitioners, the Respondents No.3, 4 & 5 are directed to decide the representation made by the petitioner dated 12/03/2025 (Annexure P/3) expeditiously as early as possible in accordance with law. 7. With the aforesaid observation, the writ petition stands disposed of. SD/- (Arvind Kumar Verma)
