This contempt proceeding is initiated by the complainant against the respondents/accused for having deliberate and willful disobedience of the order passed by

the learned Single Judge in WP.No.1054/2022 (KLR-RES) dated 12.07.2022 vide Annexure-B.
2. Learned counsel Sri Parameshwarappa C.T for the complainant and learned AGA Smt Namitha Mahesh B.G for respondent/accused Nos.1 to 4 are present. 3. Learned counsel for the complainant presses into service for consideration of the grounds urged to take action against respondents/accused. 4.
In the aforesaid WP.No.1054/2022 dated 12.07.2022 paragraph No.3 indicates as since, the petitioner is seeking for conducting of a Phodi and assessment of new survey number, it would be necessary for the Deputy Commissioner or the concerned ADLR/Tahsildar to consider her request and pass appropriate orders, within period of three months from the date of receipt of a certified copy of the order. - 4 -

Learned AGA submits for consideration of the compliance affidavit dated 03.07.2024 filed by Mr.Rajanikanth, presently working as Assistant Commissioner, Bengaluru South Sub-Division, Bengaluru wherein para No.4 of the affidavit indicates as the land to which the survey and phodi is sought, is originally a government land and that same is to be verified with the survey records and that there are some discrepancies, and the same are not matching in Column 3 and 9 of the RTC. However, to proceed with the phodi and durasth work, these discrepancies have to be rectified by the Deputy Director of Land Records. Apart from that, learned AGA also submits for consideration of the endorsement dated 01.06.2024 wherein in the last para of the said endorsement states as in the Court of Asst.Commissoner by registering the case R.A(S)186/2024003 and issue a notice for hearing, the process of counting Pahani Column 3 and 9 for Aakar Bundh area is in progress. - 5 -

Keeping in view the submission made by the learned AGA, compliance affidavit dated 03.07.2024 and endorsement, it is deemed appropriate that the present contempt proceeding do not survive for consideration to proceed against Respondents/accused.
