JUSTICE GANESH RAM MEENA Order 06/01/2025 1. This bail application has been filed by the petitioner under Section 483 of the B.N.S.S. arising out of F.I.R. No.571/2024, registered with the Police Station Sewar, District Bharatpur for offences under Sections 189(2), 109(1), 115(2), 126(2) & 307 of the B.N.S. and under Sections 3/25 of the Arms Act. 2. Heard. 3. Considered the submissions made at bar and also perused the material available on record. 4. On perusal of the averments made in the FIR, this Court finds that though the accused-petitioner has been named in the FIR but no allegation has been levelled against the petitioner for causing any kind of injury to the complainant party. The accused- petitioner is in custody since 05.12.2024. 5. Taking into consideration the overall facts and circumstances of the case so also considering the averments made in the FIR [2025:RJ-JP:544] (2 of 2) [CRLMB-15770/2024] that no specific overt act has been assigned to the petitioner, this Court without expressing any opinion on merits and demerits of the case, deems just and proper to enlarge the petitioner on bail. 6. Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before the trial Court or any other Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
