(Oral) Since it is not in dispute that in terms of mandate contained in the judgment, alleged to have been violated, respondents have considered and decided the case of the petitioner in light of
judgment passed by Coordinate Bench of this Court in CWP No.3959 of 2009, titled as Sunil Kumar Vs. State of Himachal Pradesh & Anr., no action of the respondents can be said to be contumacious. Correctness of the order passed in purported compliance of the
judgment, alleged to have been violated, cannot be gone into in the instant proceedings, which are meant to ensure compliance of orders passed by this Court. Correctness of the impugned order, if any, can be laid challenge by way of substantive writ.

In view of the above, nothing remains to be adjudicated in the instant petition and accordingly, the same is disposed of reserving liberty to the petitioner to file appropriate proceedings in appropriate Court of law, laying therein challenge to order passed in purported compliance of the judgment, alleged to have been violated. Notice issued to the respondents are discharged. December 12, 2025
