1. The petitioner has filed this petition seeking following relief (s) :
“10.1 That, this Hon'ble Court may kindly be pleased to call for the entire records of present case, from the respondents. 10.2 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ, thereby directing the respondent authorities to grant promotion to the petitioner on the post of Chief Municipal Officer with all consequential benefits from the date of promotion
order of the juniors i.e. respondents no. 3 to 6, in accordance with law. 10.3 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.”
2. Mr. Sahu, the learned counsel appearing for the petitioner would submit that the petitioner was appointed on the post of Revenue Inspector in the year 2013 and joined services on 10.07.2013. He would further submit that till date, name of the petitioner has not been considered for promotion to the post of Chief Municipal Officer. He would contend that juniors to the petitioner have already been promoted, therefore, the petitioner may be permitted to make a representation before respondent No.2 and in turn, the authority concerned may be directed to decide it strictly in accordance with law.
3. On the other hand, learned counsel appearing for State/respondents would oppose the submissions. He would submit that the promotion order of respondents No.3 to 6 has already been cancelled and writ petition filed by them has been dismissed. He would further submit that private respondents have
3 assailed the said order by filing SLP before the Hon’ble Supreme Court.
4. Heard the learned counsel appearing for the parties and perused the record.
5. Considering the fact that juniors to the petitioner have already been promoted to the next higher post and name of the petitioner has not been considered, therefore, at this juncture, the present petition is disposed of reserving liberty in favour of the petitioner to make a representation before respondent No.1 and in turn, the authority concerned is directed to consider and decide the representation expeditiously strictly in accordance with law.
6. With the aforesaid observation(s)/direction(s), the present petition is disposed of.
