This appeal is directed against the order dated 06.12.2024 passed by learned Addl. District & Sessions Judge-II, Khunti in connection with Misc. Criminal Application No. 388/2024 arising out of S.T. Case No. 137/2023 corresponding to Arki P.S. Case No. 03/2021, whereby and whereunder, the prayer for bail of the appellant has been rejected. 3. It has been alleged that an exchange of firing had taken place between the police personnel and the extremists. The extremists, however being out maneuvered, had fled away and several incriminating articles were recovered from the place of occurrence. 4. Submission has been advanced by learned counsel for the appellant that the present appellant has been implicated primarily on account of suspicion. It has further been submitted that the appellant is in custody since 30.11.2022. Learned counsel further submits that co-accused Bir Singh Paghan @ Daru has been granted bail by this Court in Cr. Appeal (DB) No. 355/2024. 5. Learned Special P.P. has opposed the prayer for bail of the appellant and has submitted that the appellant has got several criminal antecedents. 6. Regard being had to the manner of implication of the appellant, we, while setting aside the order dated 06.12.2024 passed by learned Addl. District & Sessions Judge-II, Khunti in connection with Misc. Criminal Application No. 388/2024 arising out of S.T. Case No. 2 | P a g e 137/2023 corresponding to Arki P.S. Case No. 03/2021, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge-II, Khunti in connection with S.T. Case No. 137/2023 arising out of Arki P.S. Case No. 03/2021. 7. This appeal is allowed and disposed of.
