The petitioner is apprehending his arrest in connection with Manatu P.S. Case No. 03/2025, corresponding to NDPS Case No. 01/2025, registered Under Sections 8B/18(B)/29 of the N.D.P.S. Act and U/s 33 of Indian Forest Act, pending in the Court of learned Special Judge under NDPS Act, Palamau. 3. Learned counsel appearing for the petitioner submits that the false allegations have been made against the petitioner of cultivating the opium plant in the forest area. He further submits that even the land is not belonging to this petitioner. He further submits that the petitioner has no criminal antecedent as disclosed in Para 22 of the petition. 4. Learned consul appearing for the State opposed the prayer and submits that the allegations are there of cultivating the opium plant. 5. In view of the above and considering that the petitioner has no criminal antecedent and even the land of the petitioner is being denied by the petitioner and the allegations are made of cultivation of 2025:JHHC:32223 2 opium plant in the forest area, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner above named is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Special Judge under NDPS Act, Palamau, in connection with in connection with Manatu P.S. Case No. 03/2025, corresponding to NDPS Case No. 01/2025, subject to the condition as laid down under Section 482(2) of Bhartiya Nagarik Suraksha Sanhita, 2023. 7.
