JUSTICE ARINDAM LODH Order 13/02/2025 This is an application filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for granting pre-arrest bail to the accused-applicant in connection with Nutan Bazar Police Station case no.2024/NTB/020 registered under Section 376 of IPC and Sections 69/74/117(2)/ 351(2)/329(4) of the BNS Act. Heard Mr. Subrata Sarkar, learned senior counsel appearing for the accused-applicant. Also heard Mr. R. Saha, learned Addl. PP appearing for the respondent-State. After perusal of the records, I find that the affair between the complainant and the accused person has been going on since 2007. In the meantime, they developed sexual relationship on so many occasions. Suddenly, the complaint has been lodged on 16.12.2024 by the complainant and on receipt of the same, the Officer in-Charge of Nutan Bazar Police Station registered the case under Section 376 of the Indian Penal Code, 1860 and 69/74/117(2)/351(2)/329(4) of the BNS Act. Investigation has already been undertaken. I have perused the case diary as produced by learned Addl. PP. I have also perused the statement of the victim and the injury report. Considering the nature of the complaint, as elucidated in the present application, I am inclined to confirm the interim bail granted to the accused- applicant vide order dated 06.01.2025. Accordingly, it is ordered that in the event of arrest, the accused- applicant, namely, Sri Sanjoy Debbarma shall be released on bail on furnishing a fresh bond of Rs. 50,000/- (Rupees fifty thousand) only with one surety of like amount to the satisfaction of the arresting authority. With the aforesaid order the instant anticipatory bail application stands allowed. However, the accused-applicant is directed to cooperate with the process of investigation.
