Appeal (DB) No. 552 of 2025, Mrs. Priya Shrestha, learned Spl. P.P. in Cr. Appeal (DB) No. 137 of 2025 and Ms. Kumari Rashmi, learned A.P.P. in Cr. Appeal (DB) No. 552 of 2025. 2. Both these appeals are directed against the order dated 20.12.2024 and 24.03.2025 passed in B.P. No. 323 of 2024 and B.P. No. 03 of 2023, arising out of Borio P.S. Case No. 03 of 2023 by the learned Additional Sessions Judge-1-, Sahibganj by which the prayer for bail of the appellants were rejected. 3. It has been alleged that the appellant was involved in human trafficking and they had taken away the daughter of the informant to Delhi on the promise of giving payment of Rs.12,000/- per month but after a lapse of 2-3 months the accused persons neither gave the informant money nor they made efforts to talk with her daughter. 2
4. Submission has been advanced by the learned Counsel for the appellants that one of the accused has been acquitted by the learned Trial Court.
It has further been submitted that though five girls were recovered at the behest of the appellants but the victim who has become a major had left on her own accord and is untraceable despite the efforts made by the police in tracing her out as would appear from the counter-affidavit filed by the State. It has been submitted that the appellant Punam Marandi is in custody since 09.11.2024 while the appellant Ishwar Turi is in custody since 03.02.2025. 5. Learned A.P.P. as well as learned Spl. P.P. have opposed the prayer for bail of the appellants. 6. It clearly appears that it was the appellant and the other accused persons who were involved in trafficking the daughter of the informant to Delhi after which she became traceless and despite the best efforts made by the police the victim has not yet been traced out. Since it appears that there is specific allegation against the appellants regarding their act in enticing away the victim for the purposes of getting her employed in New Delhi and the victim being still traceless, we are not inclined to interfere in the impugned orders dated 20.12.2024 and 24.03.2025 passed in B.P. No. 323 of 2024 and B.P. No.47 of 2025 by the learned Additional Sessions Judge-1-, Sahibganj in connection with S.T. Case No. 352 of 2023, arising out of Borio P.S. Case No. 03 of 2023. 7. Consequently, these appeals are dismissed at this stage. (Rongon Mukhopadhyay, J)
