Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioner has assailed order dated 13.09.2023, passed by learned Trial Court in case titled Ajay Thakur Vs. M/s Karan Krishan Transmission Project Pvt. Ltd. and others, in terms whereof, the right of the petitioner to file written statement, was closed. 2. Having gone through the impugned order and having heard learned counsel for the petitioner, though this Court finds no perversity in the order under challenge as learned Trial Court has closed the right of the defendants to file written statement after granting due opportunity, however, in the 1Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:36084 interest of justice one opportunity is granted to file the written statement subject to the payment of cost of Rs. 20,000/- by the petitioner to the plaintiff. It is made clear that as only one defendant is before the Court, the right to file written statement is hereby granted only in favour of the petitioner herein. Parties to appear before the learned Trial Court on 17.11.2025. In the event of the cost being paid by the petitioner-defendant by way of a bank draft in favor of the plaintiff-respondents on the said date, the learned Trial Court will give an opportunity to the defendant-petitioner herein to file the written statement. However, if cost is not deposited then this order will lose its efficacy. Similarly, if after deposition of cost and grant of one opportunity, no written statement is filed by the petitioner herein, no further indulgence will be shown by the Court. 3.
