Order on Board 12.08.2025
1. The petitioner has filed this petition seeking following relief (s) :
“10.1 That, this Hon'ble Court may kindly be pleased to quash impugned order dated 23- JUNE-2020 Annexure P-1 and respondent no. 1 may kindly be ordered to promote the petitioner to the post of Deputy Registrar, Co-operative Societies from 31-12-2019 i.e the date junior REKHA SINGH
-2- respondent nos. 2 and 3, have been promoted with all consequential relief with interest @ 12% of service & retiral period deserves to be ordered. 10.2 Any other relief which may be suitable in the
facts and circumstances of the case, may also be granted.”
2. Mr. Chakraborty, the learned counsel appearing for the petitioner would submit that at the relevant time, the petitioner was holding the post of Assistant Registrar Cooperative Society under the respondent authorities. He would further submit that till date, name of the petitioner has not been considered for promotion to the post of Deputy Registrar. He would contend that juniors to the petitioner have already been promoted, therefore, the petitioner may be permitted to make a representation before respondent authorities and in turn, the authority concerned may be directed to decide it strictly in accordance with law.
3. On the other hand, learned counsel appearing for State/respondents would oppose the submissions.
4. I have heard learned counsel for the parties and perused the documents placed on the record.
5. Admittedly, at the relevant time, the petitioner was holding the post of Assistant Registrar Cooperative Society under the respondent authorities.
6. It is well settled principle of law that no writ can be issued against Cooperative Society.
7. The petitioner has an efficacious alternative remedy to approach the Registrar Cooperative Society for redressal of his grievances in
3 accordance with the provisions of Section 55(2) of the Chhattisgarh Cooperative Societies Act, 1960. Thus, in my opinion, this petition is not maintainable and accordingly dismissed. However, the petitioner would be at liberty to avail remedy available under the law.
