Petitioner wants a direction to be issued to the State authorities to pay her compensation under the scheme Mukhyamantri Krishak Durghatana Kalyan Yojana on account of death of petitioner's husband on 08.03.2023. As per the application, the petitioner's husband was done to death by certain persons. Grievance is that since petitioner's application in respect of payment of compensation moved before the District Magistrate, Shahjahanpur on 15.09.2023 has not been decided, she is before this Court. 2. Learned Standing Counsel states that the aforesaid scheme for payment of compensation only relates to cases of accidental death and not cases of murder. Attention of the Court has been invited to the FIR lodged on 10.03.2023 under Section 304 IPC alongwith other sections to state that this was a case of murder and not accidental death. 3. Learned Standing Counsel relies upon a clarification issued by the State Government on 24.03.2022 to submit that the case of murder will not be included for payment of compensation under the scheme. The relevant portion of Government Order dated 24.03.2022, which is relied upon by the respondents, reads as under: " उपरररक ववषरक जजललजधकलरर अममठर कम पत वदनलनक 21.01.2022 एनव जजललजधकलरर शलमलर कम पतत वदनलनक 03.03.2021 ( छलरलपवत सनलग) कल कक परल सनदरर गहण करनम कल कष करर, जजनकम दलरल हतरल कम कवतपर पकरणत मर मरखरमनतर कक षक दरररटनल कलरलण रयजनल कम अनतररत ललर पलप हयरल रल नहह कम सनबनध मर शलसन कल मलररदशरन पदलन वकरम जलनम कल अनररयध वकरल ररल हह। 2- इस सनबनध मर मरझम रह कहनम कल वनदमश हहआ हह वक हतरल कम पकरणत मर मरखरमनतर कक षक कलरलण रयजनल कम अनतररत ललर वदरल जलनल अनरमनर नहह हयरल। कक परल तदनरसलर सरर जजललजधकलरर कय अपनम सतर सम वदशल वनदरश वनररत करनम कल कष करम।" 4. Subsequent Circular dated 06.10.2023 is also relied upon in which the aforesaid Government Order dated 24.03.2022 is reiterated and it is clearly stated that the cases of murder would not be included under the Mukhyamantri Krishak Durghatana Kalyan Yojana, for payment of compensation. 5. The object behind scheme is to grant succor to the family members who suffer untimely death of a family member in an accident. 6. Cases where a person has been done to death, apparently, is not covered under the Mukhyamantri Krishak Durghatana Kalyan Yojana. Even otherwise, it is for the State Government to extend benefit of the scheme uniformly to deal with certain exigency. Cases of murder once are excluded from purview of the scheme, no direction is required to be issued to the respondents for considering petitioner's application for grant of compensation. 8.
