Heard learned counsel for the parties and considered the case file.

Respondent No.3-Disciplinary Authority vide order dated 02.12.2023 (Annexure P-8) imposed major penalty upon the petitioner under Rule 11 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965 by ordering recovery of loss allegedly caused by the

petitioner and one other delinquent official alongwith withholding 02 increments of pay with cumulative effect. Petitioner preferred appeal under Rule 23 of the aforesaid Rules to respondent No.2-Appellate Authority on 26.12.2023 (Annexure P-9). Learned counsel for the petitioner raises a grievance that even though almost two years have gone by, but the aforesaid appeal has not been decided by respondent No.2 till date. That the petitioner is suffering on account of penalty imposed by the disciplinary authority as he is not being promoted to the post of Deputy Ranger.

Looking to the grievance of the petitioner, this writ petition is disposed of by directing respondent No.2- Appellate Authority to consider and decide the appeal preferred by the petitioner (Annexure P-9) in accordance with law within a period of four weeks from today. The decision so arrived at shall also be communicated to the petitioner.
The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
