THIS WP IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT THE RESPONDENTS TO CHANGE THE FATHER’S NAME OF THE PETITIONERS AS SHARANABASAPPA IN PLACE OF SHARANAPPA IN THEIR RECORDS AND ALSO TO CORRECT THE NAME OF THE PETITIONER’S FATHER’S NAME IN THE SSLC AND PUC MARKS CARD AND ETC.
THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM:
HON'BLE MR JUSTICE S.R.KRISHNA KUMAR
ORAL ORDER In this petition, petitioner seeks for a direction to the respondents to change the name of the petitioner’s father as ‘Sharanabasappa’ instead of ‘Sharanappa’ in their records pertaining to the petitioner by making necessary corrections in the Marks Cards, Certificates etc., issued by the respondents in favour of the petitioner.

2. Heard learned counsel for the petitioner and learned AGA for respondent Nos.1, 2, 4 and 5 and learned counsel for respondent No.3 and perused the material on record.
3. In addition to reiterating the various contentions urged in the petition and referring to the material on record, learned counsel for the petitioner submits that due to inadvertence on the part of the parents of the petitioner while admitting him to the school, the name of the petitioner’s father had been incorrectly shown as ‘Sharanappa’ instead of ‘Sharanabasappa’ and in order to avoid future complications petitioner had approached the respondents seeking correction of the name of his father in the marks cards, certificates, etc., by enclosing relevant document. Since, the respondents refused to consider the representation, the petitioner is before this Court by way of the present petition.
4. Per contra, learned AGA and learned counsel for the respondent submits that there is no merit in the petition and that the same is liable to be dismissed.
5. The material on record clearly establishes that father of the petitioner has sworn to an affidavit stating that his actual name is ‘Sharanabasappa’ and not ‘Sharanappa’, which is sufficient to

indicate that the actual name of the petitioner’s father is ‘Sharanabasappa’ and not ‘Sharanappa’ as wrongly and incorrectly stated in the Certificates, Marks Cards, etc., of the petitioner. Under these circumstances, without expressing any opinion on the merits / demerits of the rival contentions, I deem it just and appropriate to dispose of this petition by directing the respondents to rectify the father’s name of the petitioner in all his educational records.
6. In the result, I pass the following:
ORDER
(i) The petition is hereby allowed.
(ii) Respondents are directed to change the name of the petitioner’s father as ‘Sharanabasappa’ instead of ‘Sharanappa’ in all their records pertaining to the petitioner by making necessary corrections in the Marks Cards, Certificates etc., issued by the respondents in favour of the petitioner as expeditiously as possible without any delay.
