Order 13/02/2025
1. The instant bail application has been filed under Section 483 B.N.S.S. on behalf of accused-petitioners. The accused-petitioners have been arrested in connection with FIR No.663/2024, registered at Police Station Kotwali Dholpur, District Dholpur for the offence(s) under Sections 189(2), 115(2), 126(2) and 109(1) of B.N.S.
2. At the outset, learned counsel for the petitioner No.3- Manvendra S/o Mukesh, states that he does not want to press the
[2025:RJ-JP:6296] (2 of 4) [CRLMB-698/2025] present bail application qua petitioner No.3-Manvendra S/o Mukesh and seeks its withdrawal.
3.
Learned counsel for the petitioners No.1-Dileep S/o Kaptain Singh and No.2-Ravikumar S/o Kaptain Singh, submits that the accused-petitioner Nos.1 and 2 have falsely been implicated in this case. The allegations against the petitioner Nos.1 and 2 are akin to the other co-accused Manoj and Ghanshyam, who have already been enlarged on bail vide order dated 07.02.2025. The specific act of opening the firearm is against the other accused-Manvendra and not against the present accused-petitioner Nos.1 and 2 and the firearm was also recovered from possession of accused- Manvendra. None of the injuries sustained to injured Parasram, Ramkesh, Daulatram, Gopal and Bheemsen were found to be at vital part and they are not dangerous to life. The injuries sustained to the above injured are simple blunt in nature, the accused-petitioner Nos.1 and 2 are in custody since 19.12.2024, investigation/trial of the case may take considerable time, therefore, the bail application of the accused-petitioners No.1- Dileep S/o Kaptain Singh and No.2-Ravikumar S/o Kaptain Singh, may be allowed. 4. Learned Public Prosecutor has vehemently opposed the grant of bail application. It is contended that the accused-petitioners along with the other co-accused assaulted the complainant-party and caused multiple injuries to Parasram, Ramkesh, Daulatram, Gopal and Bheemsen and at the place of occurrence empty cartridge were recovered. It is also contended that the accused- petitioner No.1 Dileep is habitual offender and against him 5 criminal cases were registered under various offences, therefore,
[2025:RJ-JP:6296] (3 of 4) [CRLMB-698/2025] the bail application of the accused-petitioner Nos.1 and 2 may be dismissed. 5. Heard and perused the material available on the record. 6. It is not desirable to express anything on the merits of the case. Considering the fact that the main allegation of using firearm is against the other accused-Manvendra and recovery of 315 bore weapon was also effected from the possession of the accused-Manvendra and the accused-petitioner Nos.1 and 2 are in custody since 19.12.2024 and investigation/trial of the case may take considerable time, I deem it just and proper to enlarge the accused-petitioners No.1-Dileep S/o Kaptain Singh and No.2- Ravikumar S/o Kaptain Singh, on bail. 7. Accordingly, the bail application qua the accused-petitioners No.1-Dileep S/o Kaptain Singh and No.2-Ravikumar S/o Kaptain Singh, under Section 483 B.N.S.S. is allowed and it is ordered that the accused-petitioners Namely; 1. Dileep S/o Kaptain Singh and 2.
Ravikumar S/o Kaptain Singh, in connection with FIR No.663/2024, registered at Police Station Kotwali Dholpur, District Dholpur, shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so. 8. The accused-petitioner No.1-Dileep son of Kaptain Singh is also directed to mark his presence on 25th of every month till conclusion of trial before the concerned Police Station. The SHO of the concerned Police Station shall send the presence report of the accused-petitioner to the trial Court, every month. In case of any
[2025:RJ-JP:6296] (4 of 4) [CRLMB-698/2025] breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Court. 9. The instant bail application qua the accused-petitioner No.3- Manvendra S/o Mukesh, stands dismissed as withdrawn. (PRAVEER BHATNAGAR),J Ashwani Kr Srivastava /-1
