1. This is the second bail application of the applicant. Vide order dated 28.11.2024, passed by this Court in MCRC No. 6107 of 2024 the first bail application has been dismissed as withdrawn after argument for some time and a liberty was also granted to the applicant while dismissing the said bail application that he may revive his prayer for grant of bail after examination of the material witnesses.

2. Learned counsel for the applicant would submit that only four witnesses have been examined and the eyewitnesses of the incident have not supported the case of the prosecution therefore, he filed this second bail application.
3. On the other hand, learned State counsel opposes the bail application and submitted that four witnesses have already been examined much prior to the date of passing of the earlier order dated 28.11.2024 and therefore, there is no change of circumstance at present.

Considering the submission made by the parties particularly considering the fact that the first bail application has been dismissed as withdrawn after arguing for some time on 28.11.2024, and thereafter, no other witnesses have been examined by the prosecution and it appears that the witnesses PW01 to PW04 have already been examined in between 21.06.2024 to 11.07.2024 and there is no change in circumstance after 28.11.2024. consequently, I do not find any good ground to admit this second bail application of the applicant.
5. Accordingly, the present second bail application of the applicants is dismissed at the motion hearing stage.
