Plaintiff-respondent no.1 had filed a suit for declaration to the effect that the he is entitled to be promoted as Executive Engineer with effect from the date vide which respondent no.2-defendant no.4, who was junior to the plaintiff, was promoted. The trial Court had decreed the suit and the appeal filed by the State of Haryana was dismissed. 2. On 27.03.2006, the Co-ordinate Bench of this Court while admitting the matter, had stayed the operation of the judgment and decree of the Courts below till further orders. 3. Learned senior counsel for respondent no.1 has submitted that respondent no.1 has not approached the office of senior counsel and in spite Davinder Kumar 2025.09.26 16:50 I attest the accuracy and authenticity of this order / judgment RSA-1323-2000 2 of best efforts, he is not able to get in touch with respondent no.1 to know whether respondent no.1 wishes to pursue the present appeal. 4. Learned counsel for the appellants has submitted that the present appeal be disposed of but liberty be granted to the appellants to revive the present appeal in case respondent no.1 seeks to execute the judgment and decree or asserts his claim. 5. Learned senior counsel for respondent no.1 has submitted that respondent no.1 be granted liberty to revive the appeal in case any cause still survives. 6. In view of the above, the present appeal is disposed of with the aforesaid liberty. 7.
