ORAL JUDGMENT (PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA)
The following directions in order dated 22.04.2024 issued by learned Single Judge while disposing of the writ petition are subject matter of contempt. (i) The respondent No.1 shall examine petitioner's claim as to whether they are entitled for reservation in promotion; (ii) The respondents are hereby directed to consider petitioners representation by taking cognizance of the judgment rendered in the case of Siddaraju (supra); (iii) This exercise shall be accomplished within a period of 10 weeks from the date of receipt of a copy of this order. 2. In response to notice issued by the court, the respondents/accused have filed compliance affidavit, along with which an endorsement/Order dated 05.02.2025 passed by the Competent Authority - the Department of Personnel and

Administrative Reforms (Service Rules-1) is filed, in which it is stated that the Central Government by Notification dated 17.05.2022 has provided 4% of reservation in promotion in the cadre strength within Group-C to Group-B and from Group-B to lowest rank of Group-A posts for the benchmark disability. 3. It is further stated that in the said Endorsement that as per the Government Order dated 28.03.2023, 4% reservation in promotion of the State Civil Services for the employees with benchmark disability has been already provided to Group-D and C posts. Similarly, the extension of reservation in promotion for Group-B and Group-A (junior scale) posts in state civil services is under consideration of the State Government. 4. From the aforesaid decision, it could be gathered that the respondents have already acted towards the compliance of the directions of learned Single Judge and further that the issue is already under consideration. 5. In the circumstances, it cannot be said that there is any contempt and wilful contempt of the directions of the Court by

any of the respondents. The contempt is not liable to be continued any further. 6. It is expected that the process of consideration by the respondent-Authorities shall be taken to its logical end in accordance with law. 7. With the above said observations, the present contempt petition is disposed of as not surviving.
