GP FOR REVENUE The Court made the following: 2 THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO:28218/2024 ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking following relief: “....to Issue a Writ or Order or Direction more particularly one in the Nature of a Writ of Mandamus, declaring the inaction on the part of the respondent nos.2 to 4 in mutation of name of the petitioner in revenue records and the online entries for the land in an extent of AC.0-20 in Survey No 66/17 Patta No.179 of Jagannadha Raju Puram Village, Ransthalam Mandalam, Srikakulam District as arbitrary, abdication of statutory duty caste on them apart from being violative of fundamental rights as guaranteed to the petitioner Under Article 14, 19 and 21 of the Constitution of India all are Illegal, Unlawful, Violation of Principles of Natural Justice, Violation of Article 14, 19, 300-A of the Constitution of India Consequently to direct the 3rd Respondent to insert the Petitioner’s name in the online Adangal and also in IB for the land in an extent of Ac.0-20 cents in Survey No.66/17 Patta No.179 to an extent of AC.0-20 cents in Jagannadha Raju Puram Village, Ranasthalam Mandal, Srikakulam District in the interest of the justice and to pass...” 2. Heard learned counsel for the petitioner and learned Government Pleader for Revenue for the respondents. 3. Learned counsel for the petitioner submits that the petitioner acquired the property i.e., Zeroyati Dry land comprised in Survey No.66/17, Patta No.179, to an extent of Ac.0-20 cents out of Ac.0-48 cents, situated in Jagannadha Raju Puram Village, Ranasthalam Mandal, Srikakulam District by way of a Registered Sale deed dated 06.02.2024 vide document No.1857/2024 executed by Principal Junior civil Judge, Srikakulam on behalf of Peddisetti Erinamma, Peddisetti Pydiraju, Peddisetti Ramesh of Budi 3 Veedhi Vizianagaram District. After the purchase, the petitioner approached the 3rd and 4th respondents and informed same about the purchase of property, thereby got enquired about the mutation of name into the revenue records, on that the respondent No.4 informed the petitioner to make an application for mutation. The petitioner made an application through online and allotted a number vide No.MVT240821034449. The petitioner also affixed a thumb impression before the authorities and also made a representation personally and by way of a registered post dated 27.09.2024. 4. Learned counsel for the petitioner further submits that after submitting the mutation application, the petitioner approached before the 3rd and 4th respondents got enquired about the mutation, wherein the 4th respondent informed the petitioner that the said Web Site will be opened only through MRO Digital Sign but one way or other the 3rd and 4th respondents are postponing the mutation process. 5. Learned Government Pleader appearing for the respondents submits that the respondents would consider the applications submitted by the petitioner. 6. Having regard to the submissions made by the learned counsel for the petitioner and learned Government Pleader for the respondents and on perusal of the material placed on record, this Court is of the considered view that the present writ petition can be disposed of, directing the petitioner to make an appropriate application in Form-6A to the respondent authorities 4 strictly adhering to the provisions of the Andhra Pradesh Land in Pattadar Pass Books Act, 1971 and Rules framed therein from time to time for correction of entries in the concerned revenue records through Mee Seva/ AP Online/ Village Secretariat and also in terms of G.O.Ms.No.209 dated 14.06.2017 and on payment of requisite fee, along with all the required documents, within a period of two (02) weeks from the date of receipt of a copy of this order. On receipt of such application, the respondents are directed to consider the same and pass appropriate orders, after providing due opportunity of hearing to all the parties concerned, within a period of three (03) months, thereafter. 7. With the above directions, the writ petition is disposed of. No costs.
