ORDER: This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:-
“….to issue an appropriate Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring that the lands of an extent of Ac-8.18 cents in R.S.Nos.160/B, 168, 173/1, 173/3 and 186/2 of Thimmapuram Village, Yadlapadu Mandal, Guntur District which form part of the Master plan notified under A.P. (Urban Areas) Development Act, 1975 which is applicable to Andhra Pradesh Capital Region Development Authority Act, 2014 and are outside the purview of the provisions of The A.P. Agricultural Land (Conversion for Non-Agricultural Purpose) Act, 2006 and no permission is required from any authority for undertaking development in the said land and consequently set aside condition 2 of the notice in Rc.No.E1-198/15 dated 07.05.2015 issued by the 2nd respondent as one without authority of law….”

Heard learned counsel for the petitioners and learned Government Pleader for Municipal Administration and Urban Development for respondent No.1 and Ms.V.Sireesha Rani, learned Standing Counsel for respondent No.2. 3. When the matter came up for admission on 02.06.2015, this Court passed the following interim order:
“ ….there shall be interim direction to the respondents to release the final layout, without insisting on „No Objection Certificate‟ from the authorities under the provisions of the Andhra Pradesh Agricultural Land (Conversion for Non-Agricultural Purposes) Act, 2006. It is, however, made clear that the petitioners shall comply with all other legal requirements for the release of the final layout. The petitioners shall also file an affidavit before the respondents that in the event of their not succeeding in the present writ petition, they will discharge their liability under the provisions of the Act.”

Today, when the matter came up for hearing, learned Standing Counsel for respondent No.2 furnished a copy of instructions, wherein it is stated that pending the writ petition, the petitioners submitted a proposal for layout in D.No.160/2B, 168/2, 172/A2B, 173/1B, 3A2, 186/2B of Thimmapuram Village, Edlapadu Mandal and also paid the requisite fee for land conversion (NALA). The respondents issued an endorsement on 31.10.2017, requesting the petitioners to submit the revised plan, shortfall documents and also to pay the balance fee. Accordingly, the petitioners applied for the revised layout plan through the online layout approval system, duly submitting the requisite documents and making necessary payments. Thereafter, the respondents approved the layout vide L.P.No.77/2022/1168/APCRDA/DPMS, dated
08.08.2023. 5. In view of the above instructions, as the layout was already approved by the respondents vide L.P.No.77/2022/1168/APCRDA/DPMS, dated 08.08.2023, this Court feels that no further cause survives in this writ petition. 6. Accordingly, the Writ Petition is closed. There shall be no order as to costs.
