The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.444/2025, registered at Police Station Ratanpur, District Bilaspur (C.G.), for the offence punishable under Section 303(2) B.N.S. 2023. 2. Case of the prosecution, in brief, is that complainant made a complaint before the Police Station City Ratanpur, Bilaspur that he has installed a tubewell in his field for irrigation, which is powered by electricity through a cable wire of company CR-11. On 16.06.2025 at around 05:00 pm complainant visited his agricultural field and found the cable wire in its 2 place, but when he went back to his field on 22.06.2025 at around 06:00 am, he found that approximately 30 meters of the said wire had been stolen. Hence, the complainant has expressed serious suspicion against the present applicant and also mentioned the names of some other persons. On the basis of said complaint FIR was registered against the present applicant. 3. Learned counsel for the applicant submits that the applicant is innocent and falsely implicated in crime in question. He would submit that due to political rivalry, complainant has lodged the complaint against the present applicant, who contested the election of Sarpanch. He would further submitted that nothing has been seized from the possession of the present applicant. It is further submitted that there is no direct evidence or eye-witness against the present applicant and aforesaid FIR has been lodged only on the basis of suspicion without any cogent and credible material against him. Therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, nature and gravity of offence, also considering the fact that the present applicant has political rivalry along with the complainant, as the complainant won the election and the present applicant lost the same, which gave personal enmity between the two, I am not inclined to grant anticipatory bail to the applicant. 3 7. Accordingly, the anticipatory bail application of the applicant – Ramesh Kumar Kori, involved in Crime No.444/2025, registered at Police Station Ratanpur, District Bilaspur (C.G.) for the offence punishable under Section 303(2) B.N.S. 2023, is rejected.
